Our website and the Services on the website are built and owned by Unikery Company Limited. Your use of the website and the services described on the website www.adsmo.vn means that you agree to the contents specified in this Agreement on the Use of Services. If you do not agree, please do not access our website and the Services on our website.
Based on business practices and legal regulations, we have the right to edit, update, add or remove part or all of the terms without having to notify you directly, but will post publicly on our website.
You agree that if you continue to access our website and use the Services after the Terms of Use are updated or supplemented, it means that you have accepted and agreed to comply with the updated Terms of Use. You should regularly review the Terms of Service each time you visit the website and can view the latest version at any time at:https://www.adsmo.vn
In the event that one or more of the terms of this Terms of Service conflict with the provisions of the law and are declared invalid by the Court, that term will not be effective and will be amended to comply with the current legal provisions, the rest of the Terms of Service will remain valid.
1.1 Definition of terms
“ADSMO”: ADSMO brand belongs to Unikery Company Limited.
“We”: ADSMO and its parent companies, subsidiaries, branches and related companies, affiliated organizations, officers, employees, representatives, partners and licensed organizations of Unikery.
“You”, “Customer”, “You”: Are the people who access this website and/or legally purchase and use the products and services provided by ADSMO and have ownership of the products and services they purchase and own according to the provisions of current law.
“Email”, “Mail”: Is the abbreviation of the word “Electronic Mail” in English. Translated into Vietnamese it means “Electronic Mail”. Email (or Mail) is a means of sending or receiving content, exchanging information on the Internet.
“NameServer”, “DNS”: Is a domain name resolution system on the Internet. Simply put, DNS is a system that converts easy-to-remember domain names (Example: www.adsmo.vn) to IP addresses that are very difficult to remember (Example: 192.168.1.100).
“Email Admin”, “Registrant Email”: Is the Email address used for authentication when registering international domain names. According to the requirements of the International Domain Name Management Organization ICANN, international domain names when registered or changing information must be authenticated from the registrant’s Email address.
“Admin”: Admin is an abbreviation of the word “Administrator” which means manager, administrator, administrator. This is the highest authority of the administrator when using on storage systems or system administration.
“Download”: Is downloading data from the internet to the computer.
“File”: Is a file named and stored in storage devices such as hard disk, floppy disk, USB, CD, DVD, …
“License Key”: Is the code (or also known as the key) of copyrighted software provided by the software manufacturer. During installation or use, if not activated, the software forces you to activate the software to continue using it.
“Control Panel”: Is an English word. Translated into Vietnamese as “Control Panel”, is a tool for users to manage the system with an intuitive interface such as: Cloud Hosting, Cloud Server, Email, DNS, ID, …
ADSMO’s services are products and services listed on this website (hereinafter referred to as services).
1.2 Prohibited acts when accessing the website and/or using the service:
You use the purchased service for any purpose, in any form that violates Vietnamese law.
You use the service to or may cause harm to minors in any form.
You send, create links or transfer data that is illegal, prohibited by the State from dissemination, or contains content that threatens, incites, slanders, deceives, causes hatred, divides solidarity, violates public morality, is pornographic, insults the honor and reputation of individuals or organizations, discloses state secrets, military secrets, security, economic, foreign affairs and other secrets prescribed by law in any form that is prohibited by Vietnamese law.
You store or disseminate data that may constitute or encourage forms of violation of the law; or commit acts of infringement of copyright, intellectual property rights or infringement of business secrets, infringement of the legitimate rights of other individuals and organizations.
You upload, post, email, transmit or otherwise make available any material that contains software viruses or other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer hardware or software or telecommunications equipment.
You commit fraudulent acts or acts contrary to the provisions of this agreement or the provisions of relevant laws regarding the websites, addresses of service providers linked to us.
You impersonate any person or entity, including, but not limited to, any ADSMO official, forum leader, guide, host, or employee, or falsely state or otherwise misrepresent your affiliation with a person or entity.
You exploit the Service (Web Hosting, Domain…) beyond the resource level or violate the regulations for each type of ADSMO Service in the Final Terms.
You have behavior that hinders, disrupts the service or the use of the service by others, the servers or networks connected to the service; not comply with the requirements, procedures, policies or regulations of the networks connected to the service.
You violate the spam policies under Decree 90/2008/ND-CP dated August 13, 2008 of the Government on anti-spam or legal documents having legal value at the time of sending spam (http://www.vncert.gov.vn/files/90-2008ND-CP.doc)
You violate the current regulations of the Ministry of Information and Communications as well as the current regulations of Vietnamese law on illegal acts on the internet.
You violate the use of the logos of ICANN and ADSMO on your website. Or claiming to be an ICANN Registrar without ICANN’s permission to do so.
1.3 Rights and obligations of customers
As a customer, you have all the rights and obligations of a service lessee – as prescribed in the Civil Code and Commercial Law of Vietnam and other relevant legal provisions.
You must have full legal capacity and qualifications as prescribed by law to enter into a contract with ADSMO. You commit that you are not a person who has lost or has limited civil conduct, is bound to a third party, is involved in a judgment or decision of a competent state agency or is prohibited from performing civil transactions related to ADSMO’s services. Commit not to use information and violate the rights of any third party in registering to use ADSMO’s services or in providing information to ADSMO and using the registered service unless permitted by the third party and be responsible for your unauthorized use of information.
You are responsible for providing information as requested from the time ADSMO requests information verification and must be responsible before the law for the purpose of use and accuracy of the information you provide, ensuring that registration and use of the service are in accordance with the law, without infringing upon the rights and legitimate interests of other organizations and individuals. In case of any change in information that you do not notify ADSMO within 07 days from the date of change, or do not respond to ADSMO’s request for information verification within 15 days from the date of receipt of the notice, ADSMO has the right to suspend or cancel your registration.
You are the person who directly manages and maintains the right to use your services, is responsible for the consequences that may arise in case you violate the regulations on service use, or are caused by lax management, and must provide truthfully and fully information of the subjects licensed by you within 07 days from the date of request. The determination of the person responsible for the damage caused by the act of misuse of the domain name will be based on the information you have provided to ADSMO. Therefore, you must commit to providing accurate third party information and have the third party’s permission with the information in Article 3.5.
According to Circular 24/2015/TT-BTTTT amended and supplemented by Circular 06/2019/TT-BTTTT Regulations on the management and use of Internet resources issued by the Ministry of Information and Communications and the terms of use of international domain names of ICANN , you need to provide information related to your personal data.
The information required to be provided (such as: name, form of organization, contact address, telephone number, fax, email, identity card/household information ID card/citizen identification of the subject, domain name manager, technical manager, payer, and representative in case the subject is an organization), nameserver information (primary and secondary).
ADSMO will receive and store information related to the subject’s personal data and only provide it to relevant parties upon request from competent authorities.
During the use and maintenance of the service, you have the right to send a request to change the above information to ADSMO. Or when there is a change in the information of the transaction subject, the service user must immediately notify ADSMO in writing within 7 days from the date of change, to ensure that the information is accurate and complete. ADSMO shall not be liable, compensated or jointly liable for any consequences or damages arising from your failure to comply with this provision.
In addition, you agree to allow ADSMO to send you notifications about new registration or domain name renewal procedures and personal data provided to ADSMO.
Within 10 days from the date of successful registration for using the service, you are responsible for submitting the following documents to ADSMO: 01 (one) service contract, 01 (one) photocopy of ID card for individual registration or 01 (one) original service contract with the company seal for the service user being an organization or other reasonable documents (if any) depending on the requirements of ADSMO. In case the time for supplementing documents from the above time is exceeded, the registration service will be suspended without refund. The service will only be restored in case you supplement the documents for ADSMO and there has not been any change in the information about the service you have registered for on the system. ADSMO cannot and will not be responsible for the legal consequences, nor shall it be liable for compensation, or be jointly liable for any loss or damage arising from your failure to fully and strictly comply with this provision.
If the customer is a business or organization, you and your authorized employee are responsible for keeping your password and account information confidential, and are jointly responsible for activities that occur through the use of your password or account.
Any disputes arising from or related to the use of the domain name will be resolved in a spirit of reconciliation and negotiation. In the event that the Parties cannot resolve the dispute through negotiation, any Party has the right to request a competent court to resolve it in accordance with the provisions of Vietnamese law. You are responsible for indemnifying and holding ADSMO’s related parties harmless from any claims, liabilities, costs and losses arising from or related to the registration and use of your domain name. You are responsible for maintaining (1) the confidentiality of your account password; and (2) all activities occurring on or through your account. In the event of any unauthorized use of your password or account, you must notify us immediately and promptly change your password to keep your information secure. ADSMO will consider closing your account at any time if necessary for information security reasons. ADSMO cannot and will not be liable for any loss, damage or other liability arising from your failure to comply with this provision or from any unauthorized access to your account.
You are solely responsible for all content stored on ADSMO’s servers.
You are solely responsible for taking measures to prevent any damage or destruction to the website content or server resources.
You must understand and agree that ADSMO’s hosting services are backed up for the purpose of recovering from technical, infrastructure, or equipment failures and are not intended to provide copies to customers. Therefore, you are responsible for periodically backing up all your data stored on ADSMO’s servers and keeping them safe. Backup operations can be performed through the tools (cPanel, Plesk or Control Panel) provided by ADSMO. ADSMO is not responsible for any loss, damage, or error related to your data.
You must keep your login account information secure when using the service at ADSMO.
You are responsible for implementing the regulations and policies on software copyright, author rights, invention rights, patents, etc. when using the service at ADSMO.
1.4 Rights and responsibilities of ADSMO
As a service provider, ADSMO has full rights and obligations of a service provider as prescribed in the Civil Code, Commercial Law and other provisions of law. relevant laws.
ADSMO is committed to supporting customers in using the products and services it provides during the time customers use ADSMO’s services. All your rights and obligations will be based on the registered account information, so if there is any incorrect information, ADSMO will not be responsible in case that information affects or limits your rights, and will not proactively process data changes if you provide inappropriate or inaccurate information.
Receive and resolve customer complaints related to services, service quality arising during the use of ADSMO’s products and services, provided that customers have provided complete, honest and accurate information – according to the provisions of Article 3 above.
ADSMO is responsible for taking preventive measures to secure data from loss, misuse, unauthorized access or destruction of data. ADSMO has the right to request your cooperation to verify information if it suspects that the information provided is inaccurate or there is an act of falsifying information.
Depending on the level and nature of the customer’s violation, ADSMO has the right to unilaterally suspend, cancel, or terminate the provision of services according to Article 8 of this policy and/or transfer the case to the competent authorities to request the competent authorities to resolve it in accordance with the provisions of current law.
1.5 Payment regulations
When registering to use the service, you agree to comply with our payment instructions here:https://www.adsmo.vn. ADSMO cannot and will not be responsible or liable for any consequences or damages arising from your failure to fully comply with these payment regulations.
ADSMO will issue an electronic invoice after receiving full payment from you and the service is successfully activated.
1.6 Regulations on service renewal
You or the service manager designated by you (for businesses and organizations) are responsible for proactively monitoring information on the operating status and validity period of products and/or services registered for use at ADSMO.
Service renewal will only be performed when ADSMO receives the full service fee. The renewal will be completed within 01 day from the time ADSMO receives the full renewal service fee.
Customers proactively contact ADSMO and proceed with the renewal, paying the service fee according to the following regulations:
“.VN” domain names and international domain names – pay fees, maintenance services 10 days before the expiration date.
Server hosting services (Cloud hosting, Cloud Server, Email, server hosting, server rental, email server rental, transmission line, rack rental) – pay service fees 07 days before the expiration date.
Software license rental service – pay the service fee 07 days before the expiration date.
SSL service – pay the service fee 10 days before the expiration date.
All other services not listed above – pay the service fee 10 days before the expiration date.
ADSMO cannot and will not be responsible or liable for any consequences or damages arising from your failure to comply with this provision.
1.7 Suspension and termination of service use service
The service provided by ADSMO will be automatically terminated/suspended according to the agreement of the two parties or until the contract expires.
ADSMO has the right to suspend the performance of the contract or unilaterally terminate the service contract in the following cases:
You have violated the provisions of the Final Article: Terms of Service during the use of our products and services.
You do not cooperate and do not respond to coordinate to supplement the necessary documents according to Article 3.6 of this Agreement.
You do not renew and pay the overdue service fees to ADSMO within 15 days from the date of service expiration. ADSMO is not responsible for resolving the above cases of non-payment or overdue payment.
Before terminating the service, you must be responsible for moving all data stored on ADSMO’s server. We will not transfer or FTP your data to another provider. If you do not transfer website data or server data out of our system before terminating the service, this data will be deleted and we will not be able to provide backups for this data.
For trial or free services: Immediately after the end of the service, all these products and accompanying services and data (if any) will be canceled or revoked.
1.8 Regulations on adding and adjusting customer information during the use of the service
Customer information adjustments will be made within 24 hours from the time ADSMO receives the request for information modification and adjustment via email: info@adsmo.vn. ADSMO cannot and will not be responsible for, nor compensate for, any consequences or damages arising from your failure to comply with this regulation.
The information required to be modified or adjusted includes:
The subject and the subject’s information (contact address, phone number, name …) are incorrect or incomplete.
The service parameters are not correct as described on the website https://www.adsmo.vn/.
The registered domain name is incomplete or incorrect.
The maintenance period of other services is incorrect.
Payment and full registration information have been provided but no confirmation email has been received that the service has been successfully registered.
1.9 Customer Support
ADSMO is not responsible for responding to questions or complaints from third parties related to your use of the service. ADSMO is also not responsible for answering questions or complaints about issues related to the third-party services you are using.
ADSMO provides technical support services to your designated administrator according to the support principles applicable to the Service.
Before submitting a technical support request, you are responsible for backing up your data, attempting to fix errors yourself, checking for technical issues, functionality, checking network connections, etc. ADSMO only accepts technical support requests through 2 channels: Hotline 0356.105.488 and via email:kythuat@adsmo.vn
1.10 Limitation of liability and disclaimer of warranty
In any case, ADSMO is not responsible for the equipment and machines that you use to access our website such as: Access equipment, transmission equipment. When using the service, you must equip yourself with the necessary machinery and equipment for the login and transmission process and you must bear all responsibilities and costs arising during the use process.
ADSMO does not guarantee the exclusion of harmful factors to your use of the service, including but not limited to the following factors: intentional violations and damage from third parties, or viruses. We do not guarantee the provision of services without any malfunctions, malfunctions or other problems.
ADSMO does not guarantee to restore data when infected by viruses or remove viruses and other harmful factors when problems occur. The Customer must agree to perform regular backups of all data stored on ADSMO’s servers, especially before requesting our technical support. ADSMO will not be responsible for any loss of data or any damage related to customer data.
ADSMO does not guarantee nor is responsible for any loss of data during the process of supporting customers to transfer data from other servers or from other places to ADSMO’s server.
ADSMO does not perform SSL installation when you request in the following cases:
Your SSL digital certificate is not a service registered at ADSMO.
Your SSL digital certificate is registered at ADSMO, but requires technical support for installation on a system not hosted at ADSMO (Cloud Hosting, Cloud Server, Email).
Install SSL inside a Cloud Server that has not registered for our Premium Support Packages.
There may be factors beyond our control that result in product failure. We will try to fix product errors to bring satisfaction to customers, but we are not responsible for supporting or compensating customers for the above risks and damages (if any).
You agree to defend, indemnify and exclude Us from legal obligations, proceedings, losses, costs including but not limited to court fees, attorney fees, consultants related to the settlement or arising from your violation during the use of our products.
You expressly understand and agree that We shall not be liable for any special, consequential or exemplary damages (including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses (even if We have been advised of the possibility of such damages)) resulting from:
1) the ADSMO service, materials and products;
2) the availability or inability to use the service;
3) unauthorized access to or alteration of any data or information you transmit;
4) the actions of any third party on the Service; (v) products or messages sent or received using the Service; or
5) any other matter relating to the service, materials or products.
According to the policy prescribed by ICANN, You agree to accept the procedures for suspension, cancellation or transfer of domain names in the following cases:
a) resolving disputes related to domain name registration or
b) correcting or supplementing information due to the negligence of ADSMO or the Registrar during the domain name registration process.
1.11 Customer information security
ADSMO respects your privacy and strictly manages your information. We will collect and use your information in accordance with the Privacy Policy stated here:https://www.adsmo.vn
1.12 Free Services
Within the scope of the law and the direction of operation, ADSMO can provide one or more free services to users. The scope of free services is at the discretion of ADSMO.
All intellectual property rights existing in ADSMO’s products and services belong to ADSMO or are legally licensed to Us for use, accordingly, all legal rights are guaranteed. Unless agreed by ADSMO, you are not allowed to upload, send, publish, reproduce, transmit or distribute in any form, any component of ADSMO’s products and services.
When files, images, software, programs created by ADSMO are available for download, we allow you to use them within a limited scope for non-commercial purposes, but this permission does not mean that ADSMO has allowed you to exploit copyright. You may not download files for reproduction, posting, notification, transmission, distribution. In addition, you must comply with other instructions that we set when you want to use these files.
Users are solely responsible for the information obtained when accessing the Website. We are absolutely not responsible for ensuring the source of information and the accuracy and integrity of that content.
You can stop using our Services at any time. ADSMO will constantly change and improve its Services. We will notify you in advance within a reasonable time when there is a change or improvement in the function of our service.
Final Terms: Terms of Service
We ensure that the regulations and policies in the terms are set out to protect the rights of users for the right purpose, while aiming at service quality and long-term stability. The policies also aim to prevent abusive and illegal behavior.
