1) Decree No. 72\/2013\/ND-CP dated July 15, 2013 of the Government guiding the Management, provision and use of Internet services and information on the network.<\/span><\/p>\n

2) Circular 24\/2015\/TT-BTTTT Regulations on the management and use of Internet resources issued by the Ministry of Information and Communications (replacing Circular No. 09\/2008\/TT-BTTTT dated December 24, 2008 of the Ministry of Information and Communications guiding the management and use of Internet resources) amended and supplemented by Circular 06\/2019\/TT-BTTTT Amending and supplementing a number of articles of Circular No. 24\/2015\/TT-BTTTT of the Ministry of Information and Communications regulating the management and use of Internet resources<\/span><\/p>\n

3) Clause 2, Article 23 of the 2006 Law on Information Technology stipulates:<\/span><\/p>\n

Organizations and individuals using the Vietnamese national domain name \u201c.vn\u201d when establishing an electronic information page do not need to notify the Ministry of Post and Telecommunications. Organizations and individuals when establishing an electronic information page that does not use the Vietnamese national domain name \u201c.vn\u201d must notify the Ministry of Post and Telecommunications (now the Ministry of Information and Communications) on the network environment the following information:<\/span><\/p>\n

– The name of the organization stated in the establishment decision, operating license, business registration certificate or license to open a representative office; personal name;<\/span><\/p>\n

– Number, date of issue, place of issue of the identity card or number, date of issue, place of issue of the individual’s passport;<\/span><\/p>\n

– Address of the organization’s head office or permanent residence of the individual;<\/span><\/p>\n

– Telephone number, fax number, email address;<\/span><\/p>\n

– Registered domain names.<\/span><\/p>\n

Organizations and individuals must be legally responsible for the accuracy of This information, when changing the information, must notify about that change.<\/span><\/p>\n

4) Decree 174\/2013\/ND-CP regulating administrative sanctions in the fields of post, telecommunications, information technology and radio frequencies (replacing Decree 28\/2009\/ND-CP on administrative sanctions in the management, provision and use of internet services and electronic information on the internet), stipulates the level of sanctions for violations in the field of reporting to competent State agencies as follows:<\/span><\/p>\n

For the use of domain names: Fines from VND 5,000,000 to VND 10,000,000 for the following acts: using international domain names Declaring inaccurate information or not updating information when there is a change in contact information (address, phone number, email address, domain name manager) for the organization; contact address, telephone number, email address, identity card number or passport number for individuals registering and using the domain name \u201c.vn\u201d;<\/span><\/p>\n

For the registration and provision of internet domain names:<\/span><\/p>\n

– A fine of VND 5,000,0000 to VND 10,000,000 shall be imposed for the following acts: An international domain name registrar in Vietnam does not report the update of the list of international domain names it is managing to the Ministry of Information and Communications via the network environment in accordance with regulations on management and use of Internet resources;<\/span><\/p>\n

– A fine of 30,000,000 VND to 50,000,000 VND for the following acts: Domain name registrants do not provide information, provide incorrect information, do not cooperate or do not fully cooperate with competent state agencies in handling cases related to domain names under their management;<\/span><\/p>\n

– A fine of VND 50,000,000 to VND 70,000,000 shall be imposed for the following acts: Providing international domain name services without registering for operation, not meeting one of the conditions to become an international domain name registrar in Vietnam as prescribed by the Ministry of Information and Communications;<\/span><\/p>\n

5) Joint Circular 14\/2016\/TTLT-BTTTT-BKHCN guiding the order and procedures for changing and revoking domain names that violate intellectual property laws issued by the Minister of Information and Communications – Ministry of Science and Technology, effective from July 25, 2016.<\/span><\/p>\n

6) Circular 16\/2016\/TT-BTTTT guiding the transfer of the right to use Internet domain names granted without auction issued by the Ministry of Information and Communications, effective from August 15, 2016.<\/span><\/p>\n

7) Circular No. 05\/2011\/TT-BTTTT Regulations on handling complaints of users of services in the field of information and communications.<\/span><\/p>\n

8) Decree No. 27\/2018\/ND-CP of the Government: Amending and supplementing a number of articles of Decree No. 72\/2013\/ND-CP dated July 15, 2013 of the Government on management, provision and use of Internet services and online information<\/span><\/p>\n

9) Circular 208\/2016\/TT-BTC Stipulating the collection rates, collection, payment, management and use of fees and charges for national domain names “.vn” and Internet addresses (IP) of Vietnam<\/span><\/p>\n
